How it works
The Jersey Court essentially re-seals the Grant issued in the country of domicile and a Jersey agent is required to make the application. Corbett Le Quesne regularly act in this capacity.
To make the application we need:
- A certified copy of the death certificate
- A court sealed and certified copy of the Grant
- A court sealed and certified copy of the will (if applicable).
- Confirmation of the date of death value of the Jersey assets in the form of a letter from the asset holder
- Proof of identification of the executors/administrators named on the British Grant. This can easily be done via an online link.
- Receipt for payment of stamp duty
Once we have received the documentation, we will produce an Oath which must be signed by the executors/administrators in the presence of a suitable witness. We then submit the application to the Jersey Court and the Jersey Grant is normally issued within 7-10 working days.
We can also assist with the transfer or collection or distribution of the Jersey assets if required.
Stamp Duty is payable to the Jersey Court and is calculated on the value of the Jersey assets at the date of death at the following rate:
Estates sworn not to exceed £10,000 - Nil
Estates sworn not to exceed £100,000 - £50 per £10,000 or part of £10,000
Estates sworn to exceed £100,000 but not to exceed £13,360,000 - £500 in respect of the first £100,000 plus £75 for each additional £75 or part of £10,000
Estates sworn to exceed £13,360,000 – capped at £100,000
